I have 3 cases, all coming in within the last three weeks, dealing with the issue of possible trademark infringement when one company purchases the brand name (trademark) of a competing company.

Because I’m involved in specific client-related representation on this, I don’t feel comfortable publishing my analysis of these issues to the blog (at least not yet), but if you are facing this issue, please let me know. I’d be happy consult with you and potentially represent you.  This is really an area of law that is very fact (client) specific and one can’t really generalize about it.  The law is developing in Federal courts around the country, so we’ll keep a watch on it.

fun day

It was a fun day to be a lawyer today.  I’m working on a trademark opposition – trying to stop a competitor of my client from registering a mark that is really pretty generic and shouldn’t be allowed to be used exclusively by anyone.

I also put together a deal to help another client buy the assets of a night-club.

And, it looks like I’ll be getting involved in another juicy copyright infringment (on the good-guys’ side…).  🙂

This is exactly the type of day I wanted to have when I decided to become a lawyer.  Helping creative people – that’s what it’s all about.

More New Clients

It’s been another great month of working with creative people and businesses.  Several of the new clients this month are start-up companies that I’m helping with business formations (ranging from another new record label all the way to a company that plans to build and manage ethanol plants and work in other areas of alternative energy production).  I’ll post links to their Web sites when those sites are live.  Some of the new clients include:

New Clients

I haven’t been posting very much lately because I’ve been swamped. Fun stuff.

Here’s what I’ve been up to in the last week or two:

  1. Settled a lawsuit relating to a dispute over some software development.
  2. New client: Optimal Entertainment (business formation, operating agreement, entertainment law contracts – recording artists).
  3. New client: A Lily Production (business formation, entertainment law contract – modeling).
  4. New client: UrbanQuail Entertainment (entertainment law contracts – artist representation.)

I LOVE new clients. It’s so much fun to see what people are doing and help them reach their goal. I also like making new friends – especially with creative people. It’s such an energy pump.
I have also been asked to write a monthly column in Scene Magazine on topics relating to arts and entertainment law. Watch for the first installment next month.

TriMedia Film Festival
